Holygon Terms of Service

When you use any Holygon Products or Services, you are agreeing to these latest Terms of Service (“Terms”). Violation of these terms may, at our discretion, result is us terminating your account.

We may update these Terms of Service at any time. If we make significant changes, we will refresh the date at the top of this page and notify users who have signed up to our policy updates mailing list.

Definitions
“Company”, “we”, “our”, or “us” in any of our policies or terms, refers to Holygon AB, a Swedish company with European Union Company registry number SE559239532001 and head office post address at Dalbyvägen 5, 22460, Lund, Sweden.

“Services” refers to our websites, including holygon.com, and any product created and maintained by Holygon AB. That includes Landshape (all editions and versions), Placify, Compfire, whether delivered within a desktop application, web browser, mobile application, or another format.

Finally, “you” or “your” refers to the people or organizations that own an account with one or more of our Services. We have a specific Account Ownership Policy for our products.

Account Terms
You are responsible for maintaining the security of your account and password and for ensuring that any of your users do the same. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. Where available, we recommend all users set up two-factor authentication for added security. In some of our Services, we may require it.

You may not use the Services for any purpose outlined in our Use Restrictions Policy, and you may not permit any of your users to do so, either.

You are responsible for all content posted to and activity that occurs under your account, including content posted by and activity of any users in your account.

You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

Payment, Refunds, and Plan Changes
For paid Services that offer a free plan or a trial, we explain the length of trial at its download page. After the trial period, you need to pay in advance to keep using the Product or Service. If you do not pay, we will freeze your product or service, and it will be inaccessible until you make payment. If your account has been frozen for a while, we may queue it up for auto-cancellation. See our Cancellation Policy for more details.

If you are upgrading from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade. For other upgrades or downgrades in plan level, the new rate typically starts from the next billing cycle.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, we or our merchant of record will collect those taxes on behalf of the taxing authority and remit those taxes to taxing authorities. See our Taxes Policy for more details. Otherwise, you are responsible for payment of all taxes, levies, or duties.

We process refunds according to our Refund Policy.

Cancellation and Termination
You are solely responsible for properly canceling your account. You can find instructions for how to cancel your account in our Cancellation Policy. An email or phone request to cancel your account is not automatically considered cancellation. If you need help canceling your account, you can always contact our Support team.
All of your content will be inaccessible from the Services immediately upon account cancellation. We may then permanently delete your data from active systems and logs. We cannot recover this information once it has been permanently deleted.

If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately, and you will not be charged again. We do not automatically prorate unused time in the last billing cycle. See our Refund Policy for more details.

We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Services, at any time. Suspension means you and any other users on your account will not be able to access the account or any content in the account. Termination may furthermore result in the deletion of your account or your access to your account, and the deletion of all content in your account. We also reserve the right to refuse the use of the Services to anyone for any reason at any time, including, but not limited to violations of our Use Restrictions Policy.

Verbal, physical, written or other abuse, including threats of abuse or retribution, of a Company employee or officer will result in immediate account termination.

Modifications to the Service and Prices

We intend to support our Services as far as it is possible and reasonable to do so. Sometimes it becomes technically impossible to continue a feature, or we redesign a part of our Services because we think it could be better, or we decide to close new signups of a product. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.

Sometimes we change the pricing structure for our products. When we do that, existing customers should be exempt until the end of their active billing period. We may also post a notice about changes on our websites or the affected Services themselves.

Uptime, Security, and Privacy
Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis. We do not offer service-level agreements, but do take uptime of our applications seriously.

We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. We’ll reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.

We take measures to protect and secure your data. We try to enforce encryption for data transmission from the public Internet. There may be some edge cases where we may send your data unencrypted. Please refer to our Security Overview for full details and our Security Response page for how to report a security incident or threat.

You agree that Holygon may process your data as described in our Privacy Policy and for no other purpose. On rare occasion, our staff may access your data for the following reasons:

To help you with support requests you make. We’ll ask for express consent before accessing your account.
On the rare occasions when an error occurs that stops an automated process partway through. We get automated alerts when such errors occur. When we can fix the issue and restart automated processing without looking at any personal data, we do. In rare cases, we have to look at a minimum amount of personal data to fix the issue.

If warranted, we will assess logs and metadata as part of our work to ensure the security of your data and the Services as a whole. If necessary, we may also access accounts as part of an abuse report investigation.

To the extent required by applicable law, as a Swedish company with its main data infrastructure located in the EU, we only preserve or share customer data if compelled by a EU government authority with a legally binding order or proper request, or in limited circumstances in the event of an emergency request.

If a non-EU authority approaches Holygon for assistance, our default stance is to refuse unless the order has been approved by the EU government, which compels us to comply through procedures outlined in an established mutual legal assistance treaty or agreement mechanism. If Holygon is audited by a tax authority, we only share the bare minimum billing information needed to complete the audit.

We use third party vendors, payment processors, merchant of records, hosters, and other partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services.

Holygon is a service provider with respect to your use of the Services. That means we process any data you share with us only for the purpose you signed up for and as described in these Terms, the Privacy Policy, and other policies. We do not retain, use, disclose, or sell any of that information for any other commercial purposes unless we have your explicit permission. Similarly, you agree to comply with your requirements and not use Holygon Services in a way that violates the regulations.

These Terms elsewhere incorporate an addendum for when the EU General Data Protection Regulation, GDPR, or United Kingdom General Data Protection Regulation, UK GDPR, applies to your use of Holygon Services to process Customer Data.

Holygon Copyright and Content Ownership

All content posted on the Services must comply with copyright law.

The Company or its licensors own all right, title, and interest in and to the Services, including all intellectual property rights therein, and you obtain no ownership rights in the Services as a result of your use. You may not duplicate, copy, or reuse any portion of the Ruby, C++, HTML, CSS, JavaScript, other source code, or visual design elements, without express written permission from the Company.

You must request permission to use the Company’s logos or any Service logos for promotional purposes. Please email us requests to use logos. We reserve the right to rescind any permissions if you violate these Terms.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of the Company.

Services Adaptations and API Terms
We offer Application Program Interfaces (“API”s) for some of our Services. Any use of the API, including through a third-party product that accesses the Services, is bound by these Terms plus the following specific terms:

You expressly understand and agree that we are not liable for any damages or losses resulting from your use of the API or third-party products that access data via the API.

Third parties may not access and employ the API if the functionality is part of an application that remotely records, monitors, or reports a Service user’s activity, both inside and outside the applications. The Company, in its sole discretion, will determine if an integration service violates this bylaw. A third party that has built and deployed an integration for the purpose of remote user surveillance will be required to remove that integration.

Abuse or excessively frequent requests to the Services via the API may result in the temporary or permanent suspension of your account’s access to the API. The Company, in its sole discretion, will determine abuse or excessive usage of the API. If we need to suspend your account’s access, we will attempt to warn the account owner first. If your API usage could or has caused downtime, we may cut off access without prior notice.

Some third-party providers may create integrations between our Services and theirs. We are not liable or accountable for any of these third-party integrations.

Liability
You agree that the Company is not liable to you or to any third party for damages of any kind that result from the use of the Services, in ability to access data, or unauthorized access of your data or account. The Company is also not liable for damages of any kind related to actions of any third party that uses the Services, or any other consequences related to the Terms or Services.

Holygon GDPR Policy

This privacy policy explains how our Holygon uses the personal data we collect from you when you use our website.

Holygon complies with the European Union’s General Data Protection Regulation Act, GDPR.

Holygon protects the privacy and the personal information of our users. Holygon does not collect user information other than as made explicit to and have consented by the user, or as per below. The personal information we collect is stored in a secure and encrypted form. The user has the right to receive a copy of their current information, or have it removed from Holygon’s records.

What data do we collect?
Our Company collects the following data from users who register with a Holygon account: personal identification information, such as name, email address, countr, and similar.

How do we collect your data?
You directly provide Our Company with most of the data we collect. We collect data and process data when you: register for an account online, place an order for any of our products or services, voluntarily complete a customer survey, provide feedback on any of our message boards or via email, use or view our website via your browser’s cookies. Our Company may also receive your data indirectly from the following sources: Paddle, Cryptlex, Discourse, Trimble, and other systems integrated with Holygon’s delivery, sales, an services platforms, or partners.

How will we use your data?
Our Company collects your data so that we can: process your order, manage your account, email you with special offers on other products and services we think you might like, and help you use and update your licences products, softwares, and other entitlements.

If you agree, Our Company will share your data with our partner companies so that they may offer you their products and services.

When Our Company processes your order, it may send your data to, and also use the resulting information from, credit reference agencies to prevent fraudulent purchases.

How do we store your data?
Our Company securely stores your data, encrypted, at locations in the European Union.

Our Company will keep your data until your account is terminated. As detailed elsewhere in the Holygon terms of service, at termination we will delete your data.

Marketing
Our Company would like to send you information about products and services of ours that we think you might like, including select offers from our partner companies. If you have agreed to receive marketing, you may always opt out at a later date. You have the right at any time to stop Our Company from contacting you for marketing purposes or giving your data to other members of the Our Company Group. If you no longer wish to be contacted for marketing purposes, contact us.

What are your data protection rights?
Our Company would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The right to access – You have the right to request Our Company for copies of your personal data. We may charge you a small fee for this service.

The right to rectification – You have the right to request that Our Company correct any information you believe is inaccurate. You also have the right to request Our Company to complete the information you believe is incomplete.

Holygon Data Privacy Notice

In this notice, also called policy, we lay out what data we collect and why; how your data is handled; and your rights with respect to your data.

This policy applies to all products built and maintained by Holygon AB including Landshape, Compfire, Placify, together called “Holygon”, or “Products”.

This policy applies to our handling of information about site visitors, users, prospective customers, and customers and authorized users, in relation to their procurement of the services and management of their relationship with Holygon. We refer collectively to these categories of individuals as “you” throughout this policy.

However, this policy does not cover information about a customer’s end users that Holygon receives from a customer, or otherwise processes on a customer’s behalf, in connection with the services provided by Holygon to the customer pursuant to an applicable services agreement (including the content of messages of customer end users (“End User Communications”)). Holygon processes End User Communications under the instructions of the relevant customer, which is the “data controller” or “business” (or occupies a similar role as defined in applicable privacy laws), as described in the applicable services agreement between such customer and Holygon. Holygon’s obligations as a “data processor” or “service provider” with respect to such information are defined in such services agreement and applicable data protection addendum and are not made part of this policy.

If you are a customer’s end user and you have questions about how your information is collected and processed through the services, please contact the organization who has provided your information to us for more information.

What we collect and why
Our guiding principle is to collect only what we need. Here’s what that means in practice:

Identity and access
When you sign up for a Holygon product, we ask for identifying information such as your name, email address, and company name, and similar. That’s so you can personalize your new account, and we can send you product updates and other essential information. We may also send you optional surveys from time to time to help us understand how you use our products and to make improvements. With your consent, we will send you our newsletter and other updates. We sometimes also give you the option to add a profile picture that displays in our products.

Billing information
If you sign up for a paid Holygon product, you will be asked to provide your payment information and billing address. Credit card information is submitted directly to our payment processor and doesn’t hit Holygon servers. We may store a record of the payment transaction, including the last 4 digits of the credit card number, for purposes of account history, invoicing, and billing support. We store your billing address so we can charge you for service, calculate any sales tax due, send you invoices, and detect fraudulent credit card transactions. We occasionally use aggregate billing information to guide our marketing efforts.

Product interactions
We store on our servers the content that you upload or receive or maintain in your Holygon product accounts. This is so you can use our products as intended. We keep this content as long as your account is active.

General Geolocation data
For our products, we may log the full IP address used to sign up or use a product account, and retain that for use in mitigating future spammy signups. We may also log all account access by full IP address for security and fraud prevention purposes, and we keep this login data for as long as your product account is active.

Website interactions
We collect information about your browsing activity for analytics and statistical purposes such as conversion rate testing and experimenting with new product designs. This includes, for example, your browser and operating system versions, your IP address, which web pages you visited and how long they took to load, and which website referred you to us. If you have an account and are signed in, these web analytics data may be tied to your IP address and user account until your account is no longer active. The web analytics we use are described further in the Advertising and Cookies section.

Anti-bot assessments
We may use CAPTCHA across our applications to mitigate brute force logins and as a means of spam protection. We have a legitimate interest in protecting our apps and the broader Internet community from credential stuffing attacks and spam. When you log into your Holygon accounts and when you fill in certain forms in Holygon web pages or products, the CAPTCHA service evaluates various information, e.g., IP address, how long the visitor has been on the app, mouse movements, to try to detect if the activity is from an automated program instead of a human. The CAPTCHA service then provides Holygon with the spam score results; we do not have access to the evaluated information.

Advertising and Cookies
Holygon may occasionally run ads on various third-party platforms. Users who click on one of our ads will be sent to the Holygon marketing site. Where permissible under law, we may load an ad-company script on their browsers that sets a third-party cookie and sends information to the ad network to enable evaluation of the effectiveness of our ads, e.g., which ad they clicked and which keyword triggered the ad, and whether they performed certain actions such as clicking a button or submitting a form.

We also use persistent first-party cookies and some third-party cookies to store certain preferences, make it easier for you to use our applications, and perform A/B testing as well as support some analytics.

A cookie is a piece of text stored by your browser or software. It may help remember login information and site preferences. It might also collect information such as your browser type, operating system, web pages visited, duration of visit, content viewed, and other click-stream data. You can adjust cookie retention settings and accept or block individual cookies in your browser settings, although our apps won’t work and other aspects of our service may not function properly if you turn cookies off.

Voluntary correspondence
When you email Holygon with a question or to ask for help, we keep that correspondence, including your email address, so that we have a history of past correspondence to reference if you reach out in the future.

We also store information you may volunteer, for example, written responses to surveys. If you agree to a customer interview, we may ask for your permission to record the conversation for future reference or use. We will only do so with your express consent.

How we approach mobile app permissions
For some of our products, we may offer desktop, mobile or web apps. Because of how different platforms are designed, our apps typically must request your consent before accessing contacts, calendar, camera, and other privacy-sensitive features of your device. Consent is always optional and our apps will function without it, though some features may be unavailable.

When we access or disclose your information
To provide products or services you’ve requested. We use some third-party subprocessors to help run our applications and provide the Services to you. We also use third-party processors for other business functions such as managing newsletter subscriptions, sending customer surveys, and providing our company storefront. You can view the list at Company Processors.

We may disclose your information at your direction if you integrate a third-party service into your use of our products.

No Holygon human looks at your content except for limited purposes with your express permission, for example, if an error occurs that stops an automated process from working and requires manual intervention to fix. These are rare cases, and when they happen, we look for root cause solutions as much as possible to avoid them recurring. We may also access your data if required in order to respond to legal process (see “When required under applicable law” below).

To help you troubleshoot or squash a software bug, with your permission – If at any point we need to access your content to help you with a support case, we will ask for your consent before proceeding.

To investigate, prevent, or take action regarding restricted uses – Accessing a customer’s account when investigating potential abuse is a measure of last resort. We want to protect the privacy and safety of both our customers and the people reporting issues to us, and we do our best to balance those responsibilities throughout the process. If we discover you are using our products for a restricted purpose, we will take action as necessary, including notifying appropriate authorities where warranted.

Aggregated and de-identified data – We may aggregate or de-identify information collected through the services. We may use de-identified or aggregated data for any purpose, including marketing or analytics.

When required under applicable law – Holygon is a Swedish company with its main data infrastructure located in the European Union.

Requests for user data – Our policy is to not respond to government requests for user data unless we are compelled by legal process or in limited circumstances in the event of an emergency request. However, if EU law enforcement authorities have the necessary warrant, criminal subpoena, or court order requiring us to disclose data, we must comply. Likewise, we will only respond to requests from government authorities outside the EU if compelled by the EU authorities through procedures outlined in a mutual legal assistance treaty or agreement. It is Holygon’ policy to notify affected users before we disclose data unless we are legally prohibited from doing so, and except in some emergency cases.

Preservation requests. We do not disclose preserved data unless required by law or compelled by a court order that we choose not to appeal. Furthermore, unless we receive a proper warrant, court order, or subpoena before the required preservation period expires, we will destroy any preserved copies of customer data at the end of the preservation period.

If we are audited by a tax authority, we may be required to disclose billing-related information. If that happens, we will disclose only the minimum needed, such as billing addresses and tax exemption information.

Your rights with respect to your information
At Holygon, we strive to apply the same data rights to all customers, regardless of their location. Some of these rights include:

Right to Know. You have the right to know what personal information is collected, used, shared or sold. We outline both the categories and specific bits of data we collect, as well as how they are used, in this privacy policy.

Right of Access. This includes your right to access the personal information we gather about you, and your right to obtain information about the sharing, storage, security and processing of that information.

Right to Correction. You have the right to request correction of your personal information.

Right to Erasure. This is your right to request, subject to certain limitations under applicable law, that your personal information be erased from our possession and, by extension, from all of our service providers. Fulfillment of some data deletion requests may prevent you from using Holygon services because our applications may then no longer work. In such cases, a data deletion request may result in closing your account.

Right to Complain. You have the right to make a complaint regarding our handling of your personal information with the appropriate supervisory authority.

Right to Restrict Processing. This is your right to request restriction of how and why your personal information is used or processed, including opting out of sale of your personal information.

Right to Object. You have the right, in certain situations, to object to how or why your personal information is processed.

Right to Portability. You have the right to receive the personal information we have about you and the right to transmit it to another party.

In some cases, we also need to take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name and email address. If an authorized agent is corresponding on your behalf, we will need written consent with a signature from the account holder before proceeding.

Depending on applicable law, you may have the right to appeal our decision to deny your request, if applicable. We will provide information about how to exercise that right in our response denying the request. You also have the right to lodge a complaint with a supervisory authority. If you are in the EU or UK, you can contact your data protection authority to file a complaint or learn more about local privacy laws.

How we secure your data
All sensitive data is encrypted via SSL-TLS when transmitted from our servers to your browser. In addition, we secure your data at rest.

Data retention
We keep your information for the time necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and your choices, after which time we may delete and/or aggregate it. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Location of site and data
Our products and other web properties are primarily housed in the European Union. If you are located outside the European Union, please be aware that any information you provide to us will be transferred to and stored in the European Union. By using our websites or Services or providing us with your personal information, you consent to this transfer.

When transferring personal data from the EU
The European Data Protection Board has issued guidance that personal data transferred out of the EU must be treated with the same level of protection that is granted under EU privacy law. UK law provides similar safeguards for UK user data that is transferred out of the UK. There are also a few ad hoc cases where EU personal data may be transferred to the U.S. in connection with Holygon operations, for instance, if an EU user signs up for our newsletter or participates in one of our surveys or buys swag from our company online store. Such transfers are only occasional and data is transferred under the Article 49(1)(b) derogation under GDPR and the UK version of GDPR.

Changes and questions
We may update this policy as needed to comply with relevant regulations and reflect any new practices. If we make significant changes, we will refresh the date at the top of this page and notify users who have signed up to our policy updates mailing list.

Holygon Cancellation Policy

Account owners can follow these instructions to delete accounts, cancel subscriptions and manage other entitlements.

In the software, open the host application, e.g. Sketchup. Ensure the Product is properly installed and updated, and that you have a live internet connection. In the host application, go to menu “Extensions”, and find you Product, and click “Manage Licensing”. Now follow the instructions.

If you delete your account, you won’t be able to access your account anymore.

If you cancel, we do not automatically prorate any unused time you may have left.

Holygon-initiated cancellations
We reserve the right to cancel accounts if they have been inactive for at least 90 days, or if a payment is overdue by 90 days. We also retain the right to suspend or terminate accounts for any reason at any time, as outlined in our Terms of Service. This typically means that will cancel your account without notice if we have evidence that you are violating the restricted use agreement.

Holygon Refund Policy

If you’re ever unhappy with any Holygon Products or Services for any reason, contact our support team.

We sell subscriptions mainly on an annual basis. Subscriptions renew automatically. If you pay for a year of product access, and you then cancel before the year is up, we make sure you aren’t charged in the future, unless you should initiate a new subscription term.

If you have purchased an annual subscription and are not satisfied with it within 14 days of purchase, contact support, and let us know why, and include your payment transaction record, and we will reimburse you.

Your account will be accessible until your paid period ends. After that, your account may become inaccessible but your data will stay safe with us for at least 90 days. After 90 days, we may permanently delete all data from the account. For details, read our Cancellation Policy.

Holygon Use Restrictions Policy

Restricted purposes

When you use any of Holygon’ subscription products, you agree not to:

· Use the products to break any laws or regulations.
· Gather or use information from accounts that aren’t yours.
· Reverse-engineer the product in any way.

· Attempt to deceive us or other users by making false reports or pretending to be someone else.
· Bypass or interfere with the security features of the products.
· Overload or disrupt any configuration or operations of the products.
· Send or try to send viruses or any malware, or add tracking tools like web bugs and cookies to the products.
· Harass or threaten other users, or any of our employees.

In addition to the above, we reserve the right to suspend or cancel any account, at any time, without notice.

How to report abuse
Report violations by emailing contact@holygon.com with details about the account and the issue, including URLs or screenshots. If you need to send files securely, ask us for a link. We protect your data.

We try to send your data via https. We strive for redundancy in our systems. Our software infrastructure is updated regularly with security patches. We protect your billing information. All credit card transactions are processed using secure encryption. Card information is securely transmitted, stored, and processed.

Holygon Taxes Policy

The prices for services and products and subscriptions, in our shop and on our product websites, are all exclusive of sales tax and VAT.

Where our products are taxable, we or our merchant of record collect and remit consumption tax to governments at the local, state, or federal levels. If your billing address is in some jurisdictions, you may see an additional line item on your invoice for sales tax or VAT.

The tax rate and rules are determined by each jurisdiction and sometimes vary by whether you are using our products for business, commercial or personal purposes. As regulations change, we or our merchant of record will update the eligibilities per jurisdiction.

Holygon Account Ownership Policy

Accounts are owned by the organization detailed during signup, if this is a legal entity. If the organization is unincorporated, the account is owned by the individual who signed up for the account.

When you sign up and create a Holygon account, the person who originally signed up for the account is default designated the primary Account Owner or Manager. Uless the organization is not a legal entity, the account and data held it in, is ultimately owned by the organization.
